A town in two counties

Most of Clayton is in Kent County, but the town extends across the line into New Castle County. The town issues the building permit either way, but county-administered matters behind it differ: New Castle County works under its Unified Development Code and the Department of Land Use, Kent County under its own zoning ordinance and the Department of Planning Services.

For a straightforward in-town build on town sewer this rarely bites. For anything involving a variance, a subdivision or land just outside the corporate limits, it matters a great deal, and an assumption about which county you are in is an expensive thing to get wrong.

Lots and the scale of the place

Clayton is genuinely small, and its housing stock reflects a railroad town that grew modestly. Older lots on the original grid are compact. The newer residential development on the town's margins offers more conventional suburban ground. Custom work here tends to be individual houses rather than anything at scale.

Outside the town limits the surrounding land is agricultural, and there the Kent County rules take over: the Growth Zone Overlay determines your minimums, and without public sewer you are at half an acre with 150 feet of road frontage.

Northern Kent coastal plain. Flat, sandy loams, cooperative excavation, the same well-drained agricultural soils that run through Smyrna a few minutes east. There is nothing unusual about building here from a geotechnical point of view, which is worth saying because so much of this page is about jurisdictional complexity.

A town the size of Clayton has a small staff and a small contractor base, and both cut both ways. Questions get answered directly and quickly. Unusual requests take longer because there is less precedent.
